Community minded.
SMART Flint’s source is available to inspect, run, modify, and distribute under its Community License. It is free for eligible community use, with a commercial path for larger organizations.
This page explains SMART Flint Community License v1.0. The full license controls; third-party components retain their own terms.
What eligible users can do.
While eligible and complying with the license, you can use, run, reproduce, inspect, modify, and distribute the covered software, including in your own proprietary products. You own your original modifications. You do not have to assign your intellectual property or disclose your separate application code.
When distributing SMART Flint, preserve the license, copyright and third-party notices, and identify material modifications. Licensor-owned portions retain their eligibility conditions. Recipients receive rights directly under the license and must independently qualify or obtain a commercial license.
The license also includes a limited patent grant for the covered software as supplied, subject to its conditions. It does not grant third-party rights or trademark endorsement.
How revenue eligibility works.
The license defines an organization group through direct or indirect control, including common control. Annual gross revenue is consolidated worldwide revenue in the most recently completed fiscal year, eliminating intercompany transactions, before expenses and taxes. If no fiscal year has completed, use actual revenue since formation. Investment proceeds and loan principal are excluded.
There is no employee, contractor, funding, or valuation limit. Group revenue is assessed when use begins, at each fiscal year-end, and when control changes. A small subsidiary does not independently qualify an otherwise ineligible group.
Work performed as an employee or contractor counts as use for the organization receiving that work. A contractor may work solely under an eligible client’s eligibility, even if the contractor’s own group would not qualify; each client must independently qualify or hold an appropriate commercial license.
Evaluating before a commercial agreement.
An otherwise ineligible group can inspect and evaluate the software for up to 30 consecutive days per major version, solely in a nonproduction environment. This permits internal testing and necessary modifications for evaluation. It does not authorize production use, paid services, or distribution.
The period starts at the group’s first execution of that major version and cannot be restarted through another affiliate, contractor, or minor version. Evaluation expiry does not trigger the 90-day transition period.
When your organization grows.
If you cease to qualify after lawful community use, the license provides 90 days from the eligibility change to arrange an appropriate commercial license or stop using and distributing the software. Previously permitted use may continue under the license during that transition.
For revenue growth, loss of eligibility takes effect at the fiscal year-end when revenue reaches or exceeds the threshold. Following a change of control, the newly composed group is assessed immediately, with any loss taking effect at closing. See Sections 2 and 6 for the full rules.
Hosted services, embedded copies, and outputs.
Receiving output from an eligible operator’s standard hosted product does not, by itself, make a customer a user of SMART Flint. The operator must qualify or hold a commercial license. A dedicated outsourced installation within an ineligible client’s systems, or operated as that client’s agent for internal use, requires appropriate licensing for that client. An isolated tenant within a standard hosted offering is not, by itself, such a dedicated installation.
An ineligible customer receiving and running an embedded copy needs a commercial license covering that use, including an appropriate OEM agreement where offered. Distribution does not override the recipient’s eligibility requirements.
Data, documents, and other outputs do not acquire revenue restrictions, fees, or disclosure obligations merely because the software processed them. Rights in input data and third-party material are separate; software copies included in an output remain covered software.
Scope and third-party rights.
The Community License covers the licensor-owned SMART Flint service, console, SDKs, examples, synthetic fixtures, and accompanying documentation expressly distributed under it. It does not cover third-party components or data, real patient data, external tools, trademarks, other products, or separately licensed specification material.
The software is provided as is, without included support, maintenance, certification, or a warranty. Consult the full license for patent terms, termination, disclaimers, and liability. EasyFHIR website branding, layout, and original marketing content are separately reserved; each product has its own applicable terms.
